General Description:

We are pleased to continue the tradition of the Annual Update Conference in December, with a variety of speakers presenting the latest developments and legislation in all areas of taxation. The two-day agenda includes individual, corporate, partnership, state and local, and estate and gift taxation, and specific areas with recent changes affecting you and your clients, as well as two hours of ethics. Participants may take one day (8 hours CPE credit) or both days (16 hours).

8:30-9:30 am, Sweat Equity: Partnership Interest for Services
Managing partners can compensate service providers with a guaranteed payment or profit allocation. In this session Jim Walker, partner at Womble Bond Dickinson in Denver, will address drafting challenges of this important distinction and the alternative tax consequences faced by the tax partnership payer and the service provider, including the new §83(b) election form.

9:40 am-10:30 am, Qualified Opportunity Zones
Isaac Lodico, partner at Taft Law in Denver, will discuss changes to Opportunity Zones following the enactment of the OBBBA.

10:40 am-12:00 pm, Taming the Problem Asset: Retirement Plans
Janine Guillen of Guillen DeGeorge LLP will discuss why retirement plans are considered “the problem asset” in estate planning. Information will include navigating the complex rules around retirement plans, tax strategies for taking distributions, handling changes in beneficiaries, and other steps that may be considered to maximize retirement plan benefits.

1:00-3:00 pm, Individual Developments
Mark A. Vogel of Tax Education Services LLC will discuss the latest changes affecting individuals, including the latest rulings, notices, and the One Big Beautiful Bill (TOBBB) as it affects individuals and small businesses for 2025 and 2026. Topics include the termination of EV credits, residential energy credits, charging station credit, and IRS Direct File program; no tax on tips, overtime, and auto loan interest; senior deduction, SALT deduction of $40,000; ERC refunds; Trump Accounts and Trump Gold and Platinum cards; new distributions available for QSTPs; qualified small business stock; changes to agriculture sales and loans; treatment of payments under the Paid Family and Medical Leave Act; remittance transfers; IRS Math and Taxpayer Help Act; digital assets and Form 1099-DA; business and nonbusiness casualty losses; and the latest on changes in method of accounting.
